Welcome to the official website of Youness Aliouane. Please read through these Terms of Service carefully. By initiating a project or engaging in consultation with Youness Aliouane, you agree to these terms. If you have any concerns or questions regarding the terms, feel free to reach out before the project commences.

Payment

Deposits, Final Payments, and Delivery

I may request a 50% deposit before starting on your project. Once requested, an invoice will be sent via email, with payment expected within 30 days of issue. By remitting deposit funds, you accept these Terms of Service and enter a contract with Youness Aliouane.

The remaining balance will be invoiced before the final delivery of any logo files, visual identities, or project exports. I reserve the right to withhold delivery until full payment is received.

Should you become uncontactable or unresponsive for more than 30 days, I may issue the final invoice at my discretion for work completed to that point.

Payment plans are available upon request and may be accepted at my discretion. Any payment plan terms will be agreed upon in writing.

All payments are due within 30 days of invoice issue. Unpaid invoices beyond this period may incur fees related to collection and recovery processes.

Fonts & Typefaces

Licensing for Fonts and Typefaces Used in Your Project

Any fonts used in final designs or brand identity materials are subject to commercial licensing laws. A font/typeface license grants only the purchaser full rights to use it as necessary.

In my initial concept presentation, I will provide details about typefaces used and where they may be acquired. Obtaining the necessary font licenses (paid or free) is the client’s responsibility when approving designs.

I cannot legally share any personal copies of fonts I own with clients. If a font I own is needed for commercial use in your project, you must acquire your own license for it.

Typically, fonts used in logos are converted to vector graphics, eliminating the need for separate licensing. However, if you need a font for your own editable uses (e.g., website or printed materials), you will need to obtain a desktop license. Sources for font licensing include:

  • Fontspring
  • MyFonts or Fonts.com
  • Type Network

Restrictions

Limitations Related to This Agreement

These Terms of Service do not grant you permission to use, modify, or replicate any preliminary ideas or drafts presented during the design process. All sketches, visuals, and unused concepts remain my property.

I reserve the right to reuse unused ideas for future projects or portfolio work. When reusing similar designs, adjustments will be made to avoid conflict with your final design.

Unless otherwise arranged, I retain the right to showcase completed projects and associated designs in my portfolio and online or print publications, including galleries, awards, books, and magazines. Associated designs may include items such as commercial print designs, business cards, signage, app icons, and more.

Once final designs are delivered, you are free to modify the logo as you see fit, though such changes are made at your own risk.

Ownership & Copyright

All preliminary materials, sketches, and digital files used to create the project remain the property of Youness Aliouane until the final payment is received. Upon final payment, ownership of the final artwork is transferred to you. If final payment is not made as agreed, all concepts and designs remain my property. Should the client attempt to use or modify any ideas without completing payment, I reserve the right to pursue legal action. You may use the final design as agreed, but all unused concepts remain my property unless otherwise negotiated. Any secrecy or NDA requirements must be discussed before work begins

Trademark & Copyright

I am not responsible for assisting with any trademark or copyright registration. Clients should conduct their own due diligence in ensuring their brand name is legally available before starting a project. If a name change is required mid-project, I reserve the right to adjust project fees accordingly. Name changes after significant progress may incur additional costs and delay timelines.

Cancellation

Cancellation During the Project

Should you cancel the project after concepts or proposals have been delivered, the initial deposit is non-refundable. A portion of the funds may be refunded based on the project scope and work completed.

In the event of unforeseen circumstances preventing me from completing the project, a portion of the budget may be refunded based on work completed. Should completed work be usable by another designer, a fair refund will be arranged.

Project Suspension

I reserve the right to suspend a project if there is excessive micromanaging, ongoing disagreements after a reasonable number of unique concepts, or reluctance to make final payments. Notice will be given, and fair opportunities to remedy issues will be provided before resorting to suspension or termination. Suspended projects will not receive refunds, and all work remains my property.

Limitation of liability

If I cannot fulfill obligations due to unforeseen events (e.g., natural disasters, government actions, accidents, or shortages), this shall not constitute a breach of service. I will notify you of such circumstances and resume work once feasible.

Force Majeure

Loss or Damage

I am not liable for any loss or damage resulting from your use of my designs or services, whether due to design adjustments, third-party reliance, or errors. Any reliance on materials I provide is at your own risk.

While all designs are original to my best knowledge, clients are advised to conduct their own checks for legal compliance. I perform limited plagiarism checks, but I assume no legal responsibility for unintentional similarities. If you have concerns about originality, please address them prior to the start of the project.
